Battle Over Iconic Dallas Restaurant’s “Don’t Mess With Tex-Mex” Slogan Continues

(WBAP/KLIF News) – The saga continues between TxDOT and a legendary Mexican restaurant in Dallas.

The parent company of El Fenix, El Firebird IP, LLC,  said its pressing ahead with efforts to trademark the slogan “Don’t Mess with Tex-Mex” despite pushback from the transportation agency.

In response to TxDOT’s formal opposition to the trademark filing in June, El Fenix officials said TxDOT has not provided sufficient facts to oppose the slogan.

TxDOT said the “Don’t Mess with Tex-Mex” slogan dilutes its original and widely popular “Don’t Mess with Texas” anti-litter slogan.

El Fenix, a staple in North Texas for almost a century, said it’s not its intention to infringe upon the original slogan but to simply “celebrate their authentic recipes.”

The battle between the two has been brewing since El Firebird IP filed for the trademark last September.

In a statement, TxDOT said the company pressed forward even though the agency denied El Fenix’s request in August.

The situation could end up in court.
