Lyndo Jones’ Testimony Wraps Against Mesquite Police Officer Charged in Shooting

DALLAS (WBAP/KLIF News) – The trial against a former Mesquite police officer accused of shooting an unarmed man he thought was breaking into a truck last November continued Thursday…and the victim Lyndo Jones took the stand for the second day.

Derek Wiley is charged with aggravated assault by a public servant.

The defense questioned Lyndo Jones’ testimony that he didn’t realize Wiley was a police officer during the altercation.

“When they was asking me those things…I don’t remember because I was just saying it because that was just my truth. So, I never said it because I’ve never experienced this so it came to me piece by piece,” he said.

The defense also questioned Jones about his testimony about thinking Wiley was a civilian with a taser.

“Would I as a civilian have a taser?” said the defense attorney.

“Yes…a lot of people have tasers mam,” said Jones.

“And your comment about wanting to wish he used a taser was referencing a civilian?” said the defense attorney.

“Yes, it’s happening in America everyday,” said Jones.

Jones testified that he had been using marijuana and cocaine before the shooting and was unclear about what was happening at the time.

Jurors were also shown body camera footage from the night of the shooting. The lead investigator in the case told jurors his thoughts when he saw the video.

“Based on the video, it told me where and when…what it did not tell me was why,” he said.

The video showed a struggle between Wiley and Jones…with WIley making repeated commands.

Prosecutors argue that Wiley had no reason to fire his gun.  Testimony is expected to continue Friday.
