Ft. Worth (WBAP/KLIF News) – Officers of the Fort Worth Police Department are upset after a Tarrant County Grand Jury failed to indict Ed McIver Jr. on a charge of attempted capital murder. Sergeant Marc Povero says that’s hard for officers to grasp, given what McIver is accused of doing.
“The disappointment is rampant throughout the Police Department,” said Povero. “To know that someone was involved in the injuring of an officer, and a grand jury has decided to hold him not accountable, is very disturbing.”
Officer Matt Pearce is recovering from being hit seven times in that shootout last march. Ed McIver Sr. was killed. Povero says he’s glad the DA’s office is going to re-file charges.
Attorney Loretta Powers, host of “Powers of Attorney”, Saturday night at 9:00 on KLIF, says the DA will probably focus on intent when it re-files charges.
“I think what happened here is that they painted a picture that this innocent son was not acting poorly, it was his father,” said Powers. “But I think they’re probably going to say he knew what he was doing.”
Sergeant Povero says the department supports the DA’s plan to re-file charges against McIver Jr.
