FORT WORTH (WBAP/KLIF News) – The attorney for a man who was no-billed by a grand jury in the shooting of a Fort Worth police office is asking a judge to release his client from jail.
A hearing in Ed McIver Jr.’s case is scheduled for Monday morning.
The District Attorney’s Office said it planned to refile charges after the panel declined to indict him last week.
Prosecutors have to convince a judge that there’s enough evidence against McIver, or the judge must release him.
The man from Weatherford has been behind bars since the shooting in March which critically injured Officer Matt Pearce.
McIver’s father was killed in the shootout.
The hearing is scheduled for 9:00 a.m.
