AUSTIN (WBAP/KLIF News) – For the third time, Attorney General Ken Paxton has failed to remove the judge presiding over his criminal case.
Paxton is facing trial for securities fraud charges.
Paxton’s attorneys had asked the Judge George Gallagher to step aside twice before and argued that he could only make decisions until his assignment expired at the end of 2016.
They said Gallagher’s decision to move the trial out of Collin County in March should not stand.
In response to Paxton’s request, Judge Mary Murphy said she didn’t have the authority and that the decision should come from an appeals court.
Paxton was indicted in July 2015. Prosecutors said he tried to convince people to invest in a North Texas technology company without telling them he would receive a commission.
He has pleaded not guilty.
