Death Row Inmate Granted Retrial for Sentencing

DALLAS (WBAP/KLIF News) – An Irving man sitting on death row for the double murder of his two children will get a new sentencing hearing.

The Texas Court of Appeals ruled in their decision that Hector Medina’s defense counsel was deficient in presenting evidence during the punishment phase of his trial. Medina was sentenced to death in 2008 after being convicted of shooting each his children twice in their Irving home. The children’s mother at the time of the murder was trying to get a restraining order against Medina.

The Dallas District Attorney’s Office declined comment on the decision, only saying they respect the courts decision and will begin preparations for a retrial of his punishment hearing.
