
DALLAS – WBAP/KLIF – Now 56 years old, and jailed at age 22, Benjamin Spencer is free, as of Friday, after more than 30 years in prison. The case in which he was sentenced to 35 years for robbery, in connection with a carjacking and the murder of a clothing executive Jeffrey Young, is being officially reviewed after it was found a case witness lied and was paid for testimony. The prosecutor at that time did not tell the attorney for Spencer the eye witness who identified Spencer as being at the scene that night violated the Brady Law, requiring prosecutors to turn over exculpatory evidence that can help a defendant during trial.
Personal recognizance bond, for which no money is paid, was granted two days after Dallas County District Attorney’s office recommended Benjamin Spencer’s aggravated robbery conviction be vacated.
The Texas Court of Criminal Appeals will next review the findings and rule; the matter could take several month’s time.
