Texas Supreme Court says Dallas Salon Owner will not Serve More Jail Time for Defying COVID Restrictions

DALLAS (WBAP/KLIF) – The Dallas salon owner who kept her business open in defiance of COVID restrictions is celebrating a legal victory.

Shelley Luther was told to close the doors to Salon A La Mode last year but refused, and was thrown in jail for it. A temporary restraining order from Judge Eric Moye directed Luther to be jailed for a week, but Luther’s attorney took the case to the Supreme Court. Luther was released after two days but was still on the hook for five days in jail and $7,000 in fines.

The Texas Supreme Court ruled that the TRO was too vague and unclear, essentially voiding it.

“To say that we are pleased with the court’s ruling is an understatement,” said Luther. What happened to me can happen again. Lawmakers need to protect business owners from busy body, bureaucrats, not whitewash pandemic power grabs, empowering similar behavior in the future.”

Luther said Friday that she remains in a legal battle with the City of Dallas regarding her decision to defy COVID restrictions.
