North Texas (WBAP/KLIF) – A North Texas fitness influencer has been ordered to pay $400,000 in restitution, penalties and attorney’s fees as part of a settlement in a fraud case, according to WFAA-TV.
Brittany Dawn Davis was accused of scamming thousands of customers by not delivering fitness and nutrition plans.
She has three years to pay the civil penalties and restitution totaling $400,000. Over 131-thousand dollars in attorneys fees will not become due unless davis fails to comply with the permanent injunctions levied against her.
She cannot offer or sell her plans unless she will actually be providing them. She’s also barred from representing herself as someone who is trained in eating disorders.
The full judgement becomes due immediately if she fails to comply.
Starting in 2014, Davis sold her personalized fitness program through bdawnfit.com, which promised three months of one-on-one coaching sessions, nutritional counseling, and weekly check-ins for between $92 and $300, according to the complaint from the Texas attorney general’s office.
But in reality, according to the complaint, the services were not personalized nor were they effective. Dawn also charged users shipping fees though all the services were online, the Texas AG added in the complaint.
Since being accused of fraud, Lewis transitioned to creating religious content online.
