A Dallas federal judge has been temporarily removed from receiving new cases after a federal judicial council identified a backlog of 78 undecided motions and raised concerns about her handling of court proceedings.
The Fifth Circuit Judicial Council publicly released documents Monday, October 19, detailing ongoing judicial misconduct and disability investigations involving U.S. District Judge Ada E. Brown of the Northern District of Texas. The records also disclose allegations concerning Brown’s interactions with court employees and other judges, as well as her refusal to participate in portions of the investigation.
More Than 40 Recusals And 78 Pending Motions
The judicial council ordered Brown’s existing cases temporarily reassigned on September 29 and excluded her from receiving new assignments for three months or until further notice, whichever comes first.
According to the court’s order, a special investigative committee identified a substantial backlog of matters requiring judicial action.
The committee reported that Brown had recused herself from more than 40 cases since June 1, sometimes without explanation or for reasons investigators considered unusual.
It also raised concerns that Brown had routinely closed cases while motions remained unresolved, preventing those matters from appearing on reports required under the Civil Justice Reform Act.
A recent report identified 78 undecided motions, along with cases awaiting hearings, trials, and other judicial action.
The council concluded that temporarily reassigning her cases was necessary for the effective administration of justice.
The order did not identify every affected case or specify how quickly another judge would resolve the outstanding matters.
Investigation Involves Allegations Of Judicial Misconduct
The investigation began with a complaint alleging that Brown might be unable to perform her judicial duties because of a medical condition.
A special committee subsequently examined allegations involving her management of cases, communications with court personnel, and interactions with other judges.
The committee described concerns about inappropriate remarks, emails sent to court employees and judges, and unsupported accusations involving alterations to her docket.
On September 21, investigators ordered Brown to undergo an independent psychiatric examination within 30 days.
The court’s published records describe the committee’s concerns but do not establish a publicly confirmed medical diagnosis.
The disciplinary investigation remains ongoing.
Brown Disputes Allegations And Cites Separate Investigation
Brown has challenged aspects of the proceedings and alleged discrimination and retaliation involving judicial colleagues and court personnel.
According to the judicial council, she declined to attend a September 21 investigative meeting, stating that counsel had advised her to provide testimony only under oath because of a parallel investigation.
Brown also raised concerns about cases allegedly being transferred to and from her docket without her knowledge.
The committee said she declined to answer other questions concerning docket management and staffing, citing unspecified investigations.
In its September 29 order, the council stated that Brown had not provided a written response to its proposed case-reassignment action.
The council’s decision was not unanimous. Chief District Judge Debra Brown opposed the temporary reassignment on procedural grounds, while Circuit Judge Catharina Haynes abstained.
Confidential Documents Released Following Public Disclosure
The latest developments became public after Judge Brown distributed confidential materials concerning the disciplinary proceedings on October 17, including to members of the news media.
In an October 19 statement, the judicial council said Brown had waived confidentiality in writing.
The council subsequently voted to release documents concerning the complaints and investigation.
Those records include the September 29 case-reassignment order, a separate complaint identified by Fifth Circuit Chief Judge Jennifer Walker Elrod, and orders establishing an additional investigative committee.
The documents provide an unusual public account of disciplinary proceedings that are generally handled confidentially.
October 30 Investigative Interview Scheduled
The special committee has ordered Brown to appear for an investigative interview on October 30.
The committee is expected to continue reviewing allegations and provide findings and recommendations to the Fifth Circuit Judicial Council.
Brown remains a federal district judge. The temporary reassignment of cases does not constitute removal from judicial office or a final disciplinary determination.
The council has not publicly identified when the 78 pending motions will be resolved or whether additional administrative actions will be necessary.
