FRISCO (WBAP/KLIF) –  A dog belonging to Dallas Cowboys Quarterback Dak Prescott will remain in the care of the Collin County Animal Shelter pending the outcome of a hearing.

The dog was seized by animal services last month after witnesses say it escaped from Prescott’s home and bit a woman who intervened in a confrontation between Prescott’s dog and another dog. The woman suffered non-life-threatening injuries.

The Frisco Police Department said in a statement that the quarantine of the dog was set to be lifted Thursday but it was determined a hearing would be held to decide if the animal is a “dangerous dog” before it can be released. The case has been referred to the City of Frisco Municipal Court for a hearing.

The Texas Health and Safety Code defines a “dangerous dog” as a dog that “makes an unprovoked attack on a person that causes bodily injury and occurs in a place other than an enclosure in which the dog was being kept and that was reasonably certain to prevent the dog from leaving the enclosure on its own;  or commits unprovoked acts in a place other than an enclosure in which the dog was being kept and that was reasonably certain to prevent the dog from leaving the enclosure on its own and those acts cause a person to reasonably believe that the dog will attack and cause bodily injury to that person.”

No charges have been filed in the case.
