FORT WORTH, Texas (AP) – A Tarrant County district attorney’s office has refiled charges against a 21-year-old man in connection with the shooting of a Fort Worth police officer after a grand jury declined to indict the suspect.
Court documents show that Ed Russell McIver Jr. wasn’t indicted Wednesday on charges of attempted capital murder and possession of a controlled substance.
District attorney’s office spokeswoman Samantha Jordan says those two charges have been refiled and that McIver will remain in the Tarrant County Jail.
Court records show McIver is still charged with theft of a firearm.
Officer Matt Pearce was injured during a gunbattle March 15 that left McIver’s father, 42-year-old Ed R. McIver, dead. McIver Sr. was killed by police.
Authorities have said that McIver Sr. shot Pearce, but that his son was part of the incident.
