DALLAS (WBAP/KLIF News) — Attorneys for Dallas County Commissioner John Wiley Price were denied a mistrial, but still got a big win in his corruption trial.
The district judge said no mistrial will be granted after the government submitted new evidence without the defense getting a chance to look at it, but what she did allow is for Price’s lawyers to re-cross-examine five witnesses without prosecutors getting a chance to get the final word.
That allowed the defense to lay into an IRS agent Wednesday and question the credibility of her findings that Price failed to report income — with that testimony being the last thing the jury heard. Price’s attorneys also cross-examined the original FBI agent leading the investigation into Price, asking him specifics about terminology used during the investigation.
The trial is now on break until Monday so the defense can continue to review the new evidence, with the government expected to wrap up its case then or Tuesday. Price is facing 11 counts of bribery, tax evasion, and mail fraud, and could spend the rest of his life in prison if convicted.
